HARVEST VENTURES, INC. ANNOUNCES SETTLEMENT OF
TRADE DRESS AND COPYRIGHT INFRINGEMENT LAWSUIT
MINNEAPOLIS, MINNESOTA - June 21, 2001 - Harvest Ventures, Inc. out of Waconia, Minnesota announced today that it has settled a lawsuit it had brought against its competitor Desiccant International, Inc. out of El Monte, California. The suit claimed that Desiccant International had infringed Harvest Ventures' copyright and trade dress rights relative to packaging used in connection with Harvest Ventures' LITTER PEARLS® cat litter product. The Settlement Agreement and Court Order requires Desiccant International to pay Harvest Ventures an undisclosed amount of money. Additionally, Desiccant International must permanently stop any and all distribution of the Desiccant International packaging at issue in the lawsuit, as well as colorable imitations of such packaging. Finally, Desiccant International is permanently enjoined from marketing or selling Chinese-manufactured cat litter without indicating that such litter was manufactured in China.
Harvest Ventures brought suit against Desiccant International in 1999 asserting that Desiccant International's LITTER SECRET cat litter package violated intellectual property rights owned by Harvest Ventures relative to the Harvest Ventures packaging. The lawsuit also asserted that Desiccant International had failed to properly mark its product as having been manufactured in China.
"Although the settlement does not require Desiccant International to admit liability, the Court ordered permanent injunction on further distribution of the relevant packaging gives us the result we required in order to resolve this matter: an elimination of what we contended was likely consumer confusion over who is selling what and where the product is coming from" said Dan Schlueter, President and Chief Executive Officer of Harvest Ventures. "Obviously, we are very pleased with the result" added Schlueter.
